I also found that my axiom49 was programmed to send an on/off message everytime I pressed the sustain pedal. Whichever MIDI controller you're using, make sure that you're setting your footswitch correctly in the software editor. Also sometimes footwswitches have a polarity switch that reverses their functioning. I had similar problems with looper and in my case it turned out to be software related, but those two are the main reasons you'd running into that problem. You'll figure it out though, I literally almost broke my Axiom for a couple of days beore figuring it out!! Again, if you want some song based looping ideas, I do exactly that with covers and originals, as well as jams(which i still try to give the air of composition, or at least group improv, rather than loop based music):

Sustain pedals can sometimes be analog, i.e. sending an electric
pulse. Better would be to use a pedal that sends MIDI. Some MIDI
pedals can send many MIDI events at one button press and when that
happens it is just random luck if the right event arrives frist to the
software. If another event arrives first something else, or nothing,
will happen.

You can use anything that sends MIDI if kicked, not necessarily a
dedicated pedalboard. I have an old MC303 here  with buttons big
enough to be used as pedals. An old drum machine of any kind would do
fine if you can stomp the buttons.
